Terms and Conditions

General Terms and Conditions (GTC) of bluu AG

Status: August 2026

These General Terms and Conditions govern the legal relationship between bluu AG and its customers for orders placed via the online shop. Please read them carefully before placing any order.

1. Scope of Application

1.1 The following General Terms and Conditions ("GTC") apply to all orders and business relationships processed via the online shop of bluu AG, headquartered at Hohlstrasse 176, 8004 Zurich, Switzerland (hereinafter "bluu", "we" or "us"). The operator of the online shops and contracting party is bluu AG.

1.2 The online shop is accessible via the domain www.bluuwash.com and the associated country-specific shops. We currently deliver exclusively to customers with a delivery and billing address in Switzerland, the Principality of Liechtenstein, as well as Germany, Austria, France, Italy, Denmark, and Luxembourg.

1.3 The offer is exclusively directed at legally competent consumers with full contractual capacity as end customers («customer», «you»). A consumer is defined as any natural person who places an order for a purpose that cannot be attributed to their commercial or independent professional activity. A person has full contractual capacity once they have reached the age of 18. Orders in non-household quantities may be rejected without giving reasons.

1.4 Terms and conditions of the customer that contradict or deviate from these GTC will not be recognised unless bluu has explicitly agreed to their validity in writing.

2. Online Shop and Offer

2.1 The presentation of products in the online shop does not represent a legally binding offer, but rather an non-binding invitation to the customer to submit an offer (an order) in return. All offers are subject to change without notice.

2.2 You can select products from the assortment and add them to the virtual cart using the «Add to cart» button. You can modify your selection at any time before submitting the order. Before submitting the binding order, you will be taken to an order overview where you can review and correct your details again.

2.3 You can order as a registered customer with a user account or as a guest. For every order, the details marked as mandatory fields (including name, delivery and billing address, payment method) are required.

2.4 All information provided in the online shop (product descriptions, images, illustrations, videos, dimensions, weights, Ingredients, technical specifications, and other details) is for illustrative purposes only and should be understood as approximate values. These do not constitute an assurance of product properties or warranties, unless explicitly stated otherwise. bluu strives to provide all information accurately, completely, and up to date, but cannot offer express or implied guarantees for the correctness of this information.

2.5 bluu does not guarantee that the listed products will be available at the time of ordering. Information on availability and delivery times is provided without guarantee and may change at any time without prior notice. Price and product range changes are reserved.

2.6 Special offers, discount campaigns and loyalty programs may be modified, discontinued or revoked at any time by bluu unilaterally.

3. Order and Conclusion of Contract

3.1 By submitting the order via the corresponding button in the ordering process, you submit a legally binding offer to enter into a sales contract («order»). With the order, you simultaneously accept these GTC as applicable at the time of the order.

3.2 After you submit your order, you will receive an automatic confirmation by email, documenting the receipt of your order by bluu ("order receipt confirmation"). This order receipt confirmation does not yet constitute acceptance of your offer.

3.3 The contract is formed once bluu confirms shipment of the ordered products by email ("shipping confirmation") or delivers the products. The contracting parties are the customer and bluu AG, Hohlstrasse 176, 8004 Zurich, Switzerland.

3.4 Placed orders are binding for the customer. After receipt of the order confirmation, the order cannot be unilaterally modified – subject to differing provisions in these GTC and the right of return and withdrawal pursuant to clause 7.

3.5 If it transpires after order receipt that the ordered products are fully or partially unavailable, bluu is entitled to not accept or only partially accept/fulfil the order. In this case, the customer will be notified by email; any payments already made will be refunded immediately. If no payment has yet been made, the customer will be released from the payment obligation. No further claims are permitted.

4. Prices

4.1 The sales prices stated in the online shop are final prices. For customers with delivery and billing address:

  • a. in Switzerland or Liechtenstein: the prices are stated in Swiss francs («CHF») including statutory value-added tax and, where applicable, any other statutory levies (e.g. advance recycling fee «vRG»), plus any applicable shipping costs;
  • b. in the European Union (Germany, Austria, France, Italy, Denmark, Luxembourg): the prices are stated in euros («EUR») including the statutory value-added tax applicable in the respective country and any other statutory levies, plus any applicable shipping costs.

4.2 The prices stated in the online shop at the time of the order shall apply. Any shipping costs are shown separately during the ordering process and, unless otherwise specified, are to be borne by the customer.

4.3 If a discounted price is advertised during discount promotions, the stated reference strikethrough price corresponds to the lowest price bluu has charged within the last 30 days prior to How to use of the price reduction, insofar as this is required by law.

4.4 Technical changes, errors and typographical mistakes are reserved. In particular, bluu is entitled to contest the purchase contract in accordance with statutory provisions if an incorrect price listing is the result of an error by bluu. The listed sales prices do not include any consulting or support services.

5. Payment and Reservation of Title

5.1 The payment methods displayed during the ordering process are available. The availability of individual payment methods may vary depending on the country, order value, and the result of any credit check. The following methods are available in particular:

  • a. Credit or debit card;
  • b. PayPal;
  • c. TWINT (Switzerland only);
  • d. Invoice payment via an external payment service provider (see clause 5.5).

5.2 Payments must be made in the currency applicable for the respective region: in Switzerland and Liechtenstein in CHF, in the EU in EUR.

5.3 bluu reserves the right to exclude individual payment methods without stating reasons or to require advance payment. Orders will only be shipped – except for purchases on account – after full receipt of payment and confirmation of product availability.

5.4 In the event of payment default, bluu may charge default interest of 5% per year as well as a reminder fee of maximum CHF 20.– (or EUR 20.–) per reminder. Further statutory claims remain reserved.

5.5 Invoice payment: If you select the payment method «Invoice payment», this is processed via an external payment service provider – in Switzerland via MF Group / POWERPAY, in the European Union via the provider specified during the ordering process (e.g. Klarna). The payment service provider assumes the claim for payment and handles the payment terms. For invoice payment, in addition to these GTC, the applicable terms and conditions of the respective payment service provider valid and applicable in your area apply, which you expressly agree to during the ordering process.

5.6 The delivered products remain the property of bluu until full payment has been received (retention of title). Until ownership is transferred, the customer is not entitled to dispose of the goods by legal transaction, in particular not to pledge, assign as security, process or modify them. The customer will notify bluu immediately if third parties assert rights to the reserved goods.

6. Delivery, Duty to Inspect, and Notice of Defects

6.1 Delivery is made by post or courier to the delivery address provided by the customer. bluu strives to adhere to short delivery times; stated delivery times are non-binding approximate values, unless explicitly stated otherwise.

6.2 bluu is entitled to make partial deliveries, insofar as this is reasonable for the customer. Shipping costs will only be charged once in this case.

6.3 If delivery cannot be completed or the customer refuses acceptance, bluu may, after prior notification by email and compliance with a reasonable grace period, withdraw from the contract and charge the costs incurred for the return processing. The return and cancellation right pursuant to section 7 remains reserved.

6.4 If products are delivered with obvious transport damage to the packaging or contents, please report this to the delivery service as soon as possible – without prejudice to your warranty and cancellation rights – and additionally notify bluu of the damage.

6.5 The customer is obliged to inspect the delivered goods upon receipt and report any defects for which bluu provides warranty in writing (by email or letter to the address listed in the imprint) within a reasonable period of time. Mandatory statutory rights of consumers remain unaffected.

7. Right of Return and Withdrawal

7.1 Voluntary return and cancellation right (30 days). Beyond statutory rights, bluu grants all customers – regardless of place of residence – a voluntary return and cancellation right of thirty (30) calendar days. You may cancel the contract within this period without stating reasons and return the goods ("satisfaction guarantee"). For consumers resident in the EU, this right replaces the statutory 14-day cancellation right, but is more generous; mandatory statutory minimum rights remain protected in all cases.

7.2 Start of Period. The period is 30 calendar days from the day on which you or a third party you have appointed (other than the carrier) takes possession of the goods. For an order of multiple goods delivered separately as part of a single order, the period starts upon receipt of the last good.

7.3 Exercise. To exercise your right of return or withdrawal, you must inform us before the end of the period by means of a clear declaration (e.g. by email or letter) of your decision. The timely dispatch of the notification is sufficient to meet the deadline. You may use the model withdrawal form provided on our website for this purpose; however, it is not mandatory.
bluu AG, Hohlstrasse 176, 8004 Zurich, Switzerland, Email: hello@bluuwash.com

7.4 Return. Send the goods back to us immediately and no later than within fourteen (14) calendar days from your withdrawal declaration. The deadline is met if you send the goods before the end of this period. The goods must be returned as close to original packaging as possible, clean, and complete (including any accessories). You will receive the exact return address and return slip from our customer service; please contact them before returning the goods.

7.5 Refund. Upon effective withdrawal, we will refund all payments received from you, including the costs of standard delivery (but not the additional costs of a faster delivery method you have chosen) immediately and no later than within fourteen (14) calendar days from receipt of your withdrawal declaration. We use the same payment method as for the original transaction; no fees will be charged for this. We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.

7.6 Return shipping costs. The direct costs of return shipping are borne by the customer, unless bluu explicitly offers free return shipping (e.g. via an included or subsequently sent return label).

7.7 Loss of value. You are only liable for a loss of value of the goods if this loss results from handling the goods that is not necessary to check their condition, properties and functionality. bluu reserves the right to deduct or charge a corresponding value reduction from the amount to be refunded.

7.8 Exclusion. The right of return and withdrawal does not apply to contracts for the supply of goods,

  • that are sealed for health protection or hygiene reasons, provided their seal has been removed after delivery;
  • that are custom-made according to customer specifications or clearly tailored to personal needs;
  • that are perishable or whose expiry date would be quickly exceeded;
  • that after delivery, due to their nature, are inseparably mixed with other goods.

8. Warranty

8.1 bluu strives to deliver goods in perfect quality. For defects reported in a timely manner, bluu provides warranty for the purchased product being free of defects for the statutory warranty period – generally two (2) years from the delivery date.

8.2 It is at the discretion of bluu to fulfill the warranty by free repair, equivalent replacement, price reduction or refund of the purchase price. For consumers in the EU, the mandatory statutory provisions on the conformity of goods apply; their rights to subsequent performance, price reduction or contract cancellation remain unaffected.

8.3 The warranty does not cover normal wear and tear, as well as consequences of improper handling or damage caused by the customer or third parties, and defects attributable to external circumstances. For consumable and wear parts, warranty is excluded to the extent permitted by law.

8.4 The customer must not modify products with respect to safety-related aspects, and in particular may not remove or obscure existing warning notices, safety and usage instructions. All information affixed to the packaging and product (e.g. Dosage, safety and conformity notices) must be observed.

9. Liability

9.1 bluu excludes all liability – regardless of the legal basis – as well as claims for damages against bluu and any auxiliary persons and vicarious agents to the maximum extent permitted by law.

9.2 In particular, bluu is not liable for indirect damage, consequential damage from defects, lost profit or other personal, property and pure financial damage. Reserved is further mandatory statutory liability, in particular for intent and gross negligence, for damage resulting from injury to life, body or health, as well as under applicable product liability regulations.

9.3 bluu only uses hyperlinks to facilitate access to other websites. bluu is not familiar with the content of these individual offers and assumes no liability or responsibility for them.

10. Force Majeure

10.1 The deadline for performance is extended appropriately in the event of force majeure. Force majeure includes unforeseeable events outside the control of bluu that occur at the time of contract conclusion, in particular energy and raw material shortages, strikes, lockouts, official measures, pandemics, epidemics, natural disasters, terrorist attacks and war.

10.2 bluu will inform the customer of the occurrence of force majeure and the expected end of this circumstance. If the force majeure condition lasts continuously for more than two months, both the customer and bluu are entitled to withdraw from the contract. Any payments already made will be refunded in this case; claims for damages and further claims are excluded. This provision applies accordingly if the circumstances occur at an upstream supplier and affect the supply to bluu.

11. Copyright and Intellectual Property Rights

11.1 All graphics, texts, images, videos, trademarks, logos and programs published in the online shop or in other materials are protected by intellectual property law and may not be published, reproduced, distributed, made publicly accessible or otherwise modified or used in whole or in part without prior written consent from bluu.

11.2 Use of the trademarks, logos or other identifiers of bluu is only permitted with prior written consent from authorized representatives of bluu.

12. Data Protection

12.1 bluu processes personal data collected within the scope of the contractual relationship exclusively in accordance with applicable data protection laws, in particular the Swiss Data Protection Act (revDSG) and – where applicable – the EU General Data Protection Regulation (GDPR).

12.2 The data required for contract processing is processed for this purpose and may be passed on to commissioned service providers (e.g. logistics companies, payment service providers, service or collection partners) as required. Any further use, especially for marketing purposes, shall only occur within the limits permitted by law or with your consent.

12.3 Details of the processed data, its use, and your rights as a data subject can be found in our privacy policy at www.bluuwash.com/policies/privacy-policy.

13. Consumer Dispute Resolution and Online Dispute Settlement

13.1 The EU Commission provides a platform for online dispute settlement (OS), which you can access at https://ec.europa.eu/consumers/odr. Consumers in the EU can use this platform for the extrajudicial resolution of disputes arising from online contracts.

13.2 For consumers residing in France, a free consumer mediation procedure is also available. Details of the responsible consumer mediation body («médiateur de la consommation») will be published in the online shop or upon request.

13.3 bluu is not obliged and generally not willing to participate in a dispute resolution procedure before a consumer arbitration board; mandatory statutory participation obligations remain reserved. The right of the customer to pursue regular legal proceedings remains unaffected in all cases.

14. Changes to GTC

14.1 bluu reserves the right to amend these GTC at any time. The version applicable at the time of the order is binding; this version cannot be amended unilaterally for the relevant order.

14.2 Changes to the GTC will be pointed out at the latest during the next ordering process. By submitting a new order, the customer accepts the then applicable version of the GTC.

15. Partial Invalidity and Form Requirement

15.1 If individual provisions of these GTC or parts thereof are or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The parties shall agree on a valid regulation instead of the invalid or unenforceable provision that comes as close as possible to the economic purpose of the original provision. This applies correspondingly in the event of a regulatory gap.

15.2 Changes and additions to these GTC on an individual case basis, as well as the agreement of a warranty or the assumption of a procurement risk, require written form (email is sufficient) for their validity.

16. Applicable Law and Venue

16.1 The legal relationship between bluu and the customer is governed exclusively by Swiss substantive law, excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention), unless mandatory legal provisions apply at the consumer's place of residence.

16.2 The place of jurisdiction is Zurich (Switzerland). Mandatory statutory places of jurisdiction remain reserved, in particular at the residence of consumers. bluu is also entitled to take legal action against the customer at their place of residence.

Right of Withdrawal Notice

Right of withdrawal

You have the right to revoke this contract within 30 days without giving any reason. The revocation period is 30 days from the day on which you or a third party you have appointed, who is not the carrier, has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (bluu AG, Hohlstrasse 176, 8004 Zurich, Switzerland, hello@bluuwash.com) by means of a clear statement (e.g. a letter sent by post or email) of your decision to revoke this contract.

To meet the revocation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the end of the revocation period.

Consequences of revocation

If you revoke this contract, we shall refund you all payments we have received from you, including the delivery costs (with the exception of additional costs incurred because you chose a type of delivery other than the cheapest standard delivery we offer), immediately and no later than 30 days from the day on which the notification of your revocation of this contract is received by us. For this refund, we will use the same payment method that you used in the original transaction, unless explicitly agreed otherwise with you; in no case will we charge you fees for this refund.

For goods that, due to their nature, can normally be sent back by post, the following applies:
We may refuse the refund until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier date.
You must return or hand over the goods to us immediately and in any event no later than 14 days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the end of the period of 14 days.
You bear the direct costs of returning the goods.

You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for examining the nature, characteristics and functionality of the goods.
